Definitions


Definitions: (the following words or phrases are deemed to have the following meanings unless the context requires otherwise).

A) Administrators: The Administrator of the Site and its Affiliates is Mr. RP Webb.

B) Advertisement: any recruitment advertisement or recruitment-related advertisement or any other advertisement, provided by the Client or any other party and appearing in any accepted form anywhere on the Site and at any time.

C) Advertising Agency: refers to any client who uses the Services provided by the Site in relation to an End Client, whether such a Client receives such services on behalf of an End Client or is directly or indirectly providing the Services on to an End Client.

D) Advertisement Listing: any Advertisement that has been posted by a Client or any other party on the Advertisement listings section of the Site.

E) Advertisement Listings: the section/s of the Site and any Related Sites on which an Advertisement Listing will appear.

F) Candidate: an applicant or user of any type who uses the Services provided by the Site for the purposes of finding employment or applying to a vacancy of any type advertised on the Site in any form.

G) Client: any person or organisation or group of persons who use or purchase the Services, where such a person, organisation, or group of persons includes but is not limited to: Direct Employers, Recruitment Agencies, Advertising Agencies, or any other Recruiting body. In the circumstances of the provision of the Services provided by the Site, CV-Matchmaker will only charge the Client and not the Client’s End Client.

H) Contract: the contract for the provision of any Services provided by the Site and comprising these Terms and Conditions and a Service Agreement.

I) CV: the curriculum vitae, or any form of any provision of a candidates details which includes but is not limited to any details of any kind of a Candidate’s education, skills, training, employment experience, and contact details which is or has been provided to the Site by a Candidate for distribution to Clients in any way for the purposes of securing employment.

J) Direct Employer: a Client who receives or makes use of the Services provided by the Site for the purposes of their own recruitment needs and not on behalf of any other third party or End Client.

K) Discount Package: a payment option whereby Client’s are able to purchase the right to post a set amount of Advertisements at a specific amount decided upon by the Site or its Administrators. The payment amount is for the package itself and not for individual Advertisements it allows and it therefore follows that no refunds are payable by the Site for any unused elements of the package.

L) End Client: the person or body to whom the Client’s services are ultimately provided.

M) Featured CV’s: a Service whereby a Candidate has allowed the featuring of his or her full CV on the Site and is thereby allowing Clients or Users of any type to view and store such information strictly for the purposes of allowing or enabling the Candidate to secure suitable employment (this is at the Candidate’s own risk and the Site or its Administrators will not be liable for any use or misuse of or access to this information by any Visitor).

N) Fees: the fees and charges payable by the Client.

O) Header Banner: any banner advertisement appearing in and displayed in the header of any page on the Site.

P) Live Advertisement: an Advertisement which is currently live and viewable on the Site.

Q) Recruiter: any person or body working in any capacity or on behalf of a Direct Employer, Recruitment Agency or Advertising Agency for the purposes of using the Site and its Services to advertise employment-related vacancies and/or find information on suitable Candidates to fill any employment-related needs or vacancies.

R) Recruitment Agency: any business or Employment-Related Business or Employment Agency as defined by the Employment Agencies Act 1973 (and all regulations that have been made thereunder).

S) Related Site: any Site which has a direct affiliation with the Site and shares the Services provided by the Site. These sites so far include www.pubjobslondon.com.

T) Services: the Services which the Site agrees to provide to Clients and Candidates and includes the hosting of Advertisements, featuring of CVs, CV filtering, CV match-making, and any other Services which may be provided.

U) Service Agreement: the Service Agreement entered into between the Client and the Site.

V) Site: the Site at www.cv-matchmaker.com or any other Related Site on which or through which any of the Services offered by CV Matchmaker and the Site are provided.

W) Start Date: the start date for the provision of the Services referred to and identified in the Service Agreement.

X) Term: the time period during which the Advertisement will be available and viewable on the Site as a Live Advertisement. The term for posting an Advertisement into the Advertisement Listings sections of the Site is currently 60 days from the date that the Advertisement is electronically-submitted to the Site.

Y) Terms and Conditions: these standard Terms and Conditions.

Z) Vacancy Listing: a page or section of the Site which lists all the live Advertisements of any Client or any body as allowed by the Site.

AA) Visitor: an internet-user who visits and/or uses for any purpose any page, part, or Service of the Site for any reason and at any time.

Terms and Conditions: General


A) All the information and advice found on or through the Site is used by a Client, Candidate, or Visitor of the Site entirely at their own risk and discretion. The Site and its Administrators will not be held liable for the consequences, in whatever form, of any use of any information whatsoever found using the Site for whatever reason.

B) The Site reserves the right to continually modify, change, or move the layout of the Site including any Advertisement content at any time if necessary or desirable for organisational, developmental, or presentational purposes.

C) The Site does not make any representation of any kind about any Advertisement content related to the Site whether accessed on, by virtue of, or by way of links from or to the Site nor about any of the Clients who use the Services of the Site. The Site relies on information provided to it by Clients and/or third parties and therefore it is the Candidate’s or Visitor’s responsibility to satisfy itself as to the suitability of any Advertisement content and/or any Client found using the Site whether directly or indirectly.

D) The Site reserves the right to, at any time and without notifying Clients or Candidates, modify, change or otherwise amend the Services it provides and shall determine the manner in which the Services are provided in its absolute discretion.

E) Any and all ideas, concepts, techniques, methods, or other form of intellectual property developed by the Site or obtained during the execution of the Services is and shall be considered the exclusive property of the Site.

F) The Site cannot be held responsible for any unavailability of the Site or its Services, or the failure of the Site and/or its Services resulting from circumstances beyond its reasonable control.

G) The Site reserves the right to, at its sole discretion and without notice, report improper or illegal use of CV’s or its Services.

Terms and Conditions: Clients


Recruiters need to agree to both the Full Terms and Conditions and Posting Rules of the Site before posting jobs ads

A) The Client agrees to provide the Site with all information required by the Site to provide the Services offered by the Site and to pay all the necessary Fees associated with the purchase of any Service of the Site in a timely manner.

B) The Client agrees to word an Advertisement posted on the Site itself and within the parameters set out in the Posting Rules and is solely liable for this content.

C) The Client is solely responsible for the electronic submission of the Advertisement content to the Site and the Site and its Administrators will not be liable or responsible for any of this Advertisement content. This includes but is not limited to the accuracy, completeness, and legality of this information. The Site will not be liable for any omissions, errors, or duplications made during the electronic submission, processing, and/or posting of the Advertisement by the Client to the Site.

D) The Site cannot and does not guarantee that the Services provided will lead to the successful filling of a Client’s advertised vacancy/position, or the success of the Client’s or End Client’s advertising campaign in general.

E) The Client accepts that they are solely responsibly for assessing the accuracy and truthfulness of the information or details contained in a CV or otherwise that is sent to the Client by the Site, its Administrators, or a Candidate, or that of the information or details of any Candidate found on or through the Site.

F) The Client accepts that they are solely responsible for assessing whether a Candidate found through the Site or its Services is legally, morally, or otherwise suitable for the Client’s employment-related purposes and that any such Candidate has the legal right to work for the Client in accordance with any immigration, professional, or any other regulations and obligations.

G) The Client acknowledges and accepts that any and all employment matters between the Client and a Candidate do not involve the Site or its Administrators in any way and remain between the Client and the Candidate.

H) After the Advertisement has been electronically submitted or otherwise posted on to the Site, the Client may at any reasonable time delete any of the Advertisement content from the Site. In the event of this taking place, the Client will remain subject to the full Fees incurred (unless otherwise agreed by the Site).

I) In the event of a Discount Package being purchased by a Client, the Client will not be entitled to any refund for Advertisement Listings not used, or for Advertisements submitted and subsequently deleted, or for any duplications in the submission of an Advertisement when this is the result of the Client’s negligence or improper use of the Site.

J) The Client may modify and re-post an existing, live Advertisement Listing for no extra cost once per day throughout the Advertisement's lifespan (60 days from date of first live listing). The Site and its Administrators reserve the right to remove/delete Listings where abuse of this allowance is taking place.

K) The Site reserves the right to modify and/or delete any Advertisement or refuse to post or allow the electronic submission of any Advertisement or Advertisement content to the Site if:

K.1) The content of the Advertisement is not consistent with the Site’s reasonable advertising standards;

K.2) The content of the Advertisement either does or is likely to breach any applicable law or regulation;

K.3) The content of the Advertisement is not currently or is not likely to be consistent with the Site’s Posting Rules;

K.4) The Client has breached or is likely to breach any of the Terms and Conditions;

K.5) The content of the Advertisement is obscene, blasphemous, defamatory, discriminatory, illegal, or infringes on the Intellectual Property Rights of any individual or organisation.

L) The Site reserves the right to, at any time, remove, delete, suspend, or refuse to accept any Advertisement of a Client who fails a credit-check carried out either by the Site or a third party or if the Client resells any of the Services on to a third party.

M) The Client uses the Site at its own risk and the Site or its Administrators will not be liable for any incorrect or improper usage of a Client’s payment card/details/information as a result of the Client’s own negligence.

N) The Site reserves the right to delete, remove, or suspend any Advertisement without any reason and at any time. In the event that such a deletion, removal, or suspension takes place after payment by the Client has been made and received, the Site will only refund the Fees for any Advertisement advertised on the Site that has not been deleted, removed, or suspended due to a breach of the Terms and Conditions and/or the Posting Rules and is still currently a Live Advertisement and has at least 30 days remaining in its Term.

O) The Client agrees that any relationship to the Site will come to an end once the Candidate's anonymous email address has been passed on to the Client. It will then be up to the Client to contact the Candidate and begin the recruitment process and the Client will need to comply with all necessary Data Protection regulations while undertaking this process.

Terms and Conditions: Candidates


NB: This Site at www.cv-matchmaker.com and its Administrators only require the provision of a Candidate's brief work history, skills, qualifications, and personal attributes which cannot be used to identify the Candidate, along with an anonymous email address. Any information provided by a Candidate which could be used to personally identify the Candidate will constitute a fundamental breach of these Terms and Conditions and this information (along with any other information provided by such a Candidate) will be immediately and permanently deleted and the Candidate's job application will not be processed. Please see Term "N" under this section for further clarification.

A) The Candidate acknowledges and accepts that the Site cannot provide any Services to the Candidate unless the Candidate provides all the information necessary and in such a format as the Site requires.

B) The Services provided by the Site are subject to any instructions from a Candidate that his or her information and details should not be made available to the Client and the Site will only make available, send, or supply copies of a Candidate’s CV which have been received by it for distribution to Clients solely for the purposes of securing suitable employment for the Candidate.

C) On a Candidate allowing the Site to use the Candidate’s information and other details obtained in the Candidate’s CV for the purposes of displaying this information on the Featured CV’s section of the Site and/or sending this information on to third parties, the Candidate agrees that this is at the Candidate’s own risk and that the Site or its Administrators cannot be held responsible in any way for any misuse of, or any other use of or access to, this information by another party.

D) The Site cannot and does not guarantee the number of times a Candidate’s CV will be viewed by or distributed to Clients.

E) The Site reserves the right to, at its sole discretion, decline to distribute or forward a Candidate’s CV, or to remove or delete a Featured CV featured on the Site.

F) The Site will, at its sole discretion, choose which CV’s to feature on the Featured CV’s section of the Site.

G) The Candidate undertakes that:

G.1) the information and details they provide whether in the form of their CV or otherwise to the Site or its Administrators or to any Client of the Site are true and accurate;

G.2) if any of the details and/or information provided to the Site or its Administrators or to any Client of the Site for the purposes of securing employment is found to be incorrect, inaccurate, or false in any way, the Site reserves the right to remove, delete, amend, or modify the incorrect, inaccurate, or false information without notice to the Candidate and without the Candidate’s permission. Additionally, the Site and its Administrators reserve the right to inform any third party of the incorrect, inaccurate, or false nature of this information;

G.3) the details and information they provide to the Site or its Administrators or to any Client of the Site will not contain any obscene, blasphemous, defamatory, discriminatory, illegal, or confidential content, or any content which infringes on the intellectual property, moral, or confidentiality rights of any individual or organisation in any way;

G.4) they are solely responsible for any information or details provided to the Site or its Administrators or to any Client of the Site, or to any third party to which this information is forwarded to by the Site, its Administrators, or any Client of the Site. The Candidate accepts full and sole legal responsibility for this information and its use by other parties for the purposes of the Candidate securing employment;

G.5) the Candidate acknowledges and accepts that any and all employment matters between the Candidate and a Client do not involve the Site in any way and remain between the Candidate and a Client.

H) The Candidate acknowledges and accepts that submission of the Candidate’s information, details, and/or CV to the Site, its Administrators, or a Client of the Site does not necessarily guarantee that the Candidate will secure suitable (or any) employment.

I) The Candidate is to ensure that he or she satisfies or will attend to the necessary immigration requirements of and are entitled to work in the country in which the employment-related position will be situated.

J) When a candidate submits his or her information and/or details to the Site or its Administrators whether in the form of a CV or otherwise for the purposes of replying to an Advertisement found on the Site and/or securing employment, the Site will pass this CV/information/details to the Client who placed the Advertisement to which the Candidate has replied to at the Site’s or its Administrator’s own discretion and the passing on of the Candidates CV/information/details in this regard by the Site or its Administrators is by no means guaranteed. The Site and its Administrators reserve the right to choose at their own discretion whether to inform or not to inform a Candidate or a Client if such information provided by the Candidate for the purposes of securing employment has been passed on in any way to the Client.

K) When a candidate submits his or her CV/information/details to the Site or its Administrators for the purposes of replying to an Advertisement found on the Site and/or securing employment, the Candidate acknowledges and accepts that this information may, at the sole discretion of the Site or its Administrators, be passed on to relevant recruiters to which the Site or its Administrators feel that the Candidate will compliment in employment-related terms unless the Candidate expressly makes known his or her wish to the Site or its Administrators that he or she wishes this not to take place. In other words, the Site and its Administrators will endeavour to match Candidates to any Clients which the Site or its Administrators feel would appreciate receiving such a Candidate’s information for the purposes of securing employment for the candidate.

L) To further clarify Candidate Term "K" above - because of the nature of the Services offered by the Site (CV matchmaking), a Candidate's CV and/or job application may be matched to all suitable jobs for which the Candidate is deemed qualified, and these jobs therefore may or may not relate to the specific job advertisements that the Candidate originally applied to. If Candidates do not want this beneficial service then they should make this clear to an administrator of the Site either on his or her CV or through the Contact Us section of the Site.

M) Job advertisements may be placed on the Site by Recruiters and/or by an Administrator of the Site. The Site and its Administrators can by no means guarantee that any Advertisements placed on the Site will not get placed or have not been placed on any other jobs site, jobs board, or jobs advertising medium. Therefore, any job Advertisements found on or through the Site may be advertised by a third party and may relate to a job Advertisement not originally placed on the Site.

N) IMPORTANT: Candidate's are required to remove from their CV's (or any other form of information provided by Candidates with the purpose of applying for a job advertised on the Site or for any other reason), any form of information which could enable their personal identification before submitting any information in any form to or through the Site. This information which may not be disclosed by Candidates to the Site (that which could be used by any party to identify a Candidate) includes, but is not limited to, a Candidate's first and last name; address; visa/passport/national insurance number or any personal identification number; or any contact details of any kind except an anonymous email address; or any other information of any kind which could enable the personal identification of the Candidate in any way. The Site or its Administrators do not require any such personal information from a Candidate which could enable the personal identification of the Candidate in any way and if any such information is provided by a Candidate the submission of this information will be regarded as constituting a fundamental breach of these Terms and Conditions and all such information (along with any other information provided by the Candidate not in breach of these Terms) will be immediately and permanently deleted and the Candidate's job application will not be processed in any way. The Site only requires a Candidate's work history, skills, qualifications, and personal attributes which cannot be used to identify the Candidate. By submitting their information to the Site for the purposes of applying for a job advertised on the Site (or for any other reason), Candidates' agree to have this information relating to their work history, skills, qualifications, and personal attributes matched to jobs for which they are suitable and have only their anonymous email address supplied to the Client who has created the advertisement. It will then be up to the Client to contact the Candidate through the anonymous email address supplied by the Candidate and any relationship to the Site on the part of either the Candidate or the Client will thus come to an end. Candidates need to agree to this last statement (that of the relationship to the Site ending once their information has been passed on to the Client) before submitting any information to or through this Site.

Liability


A) The Site and its Administrators do not accept liability of any description, including any form of liability for negligence (except for personal injury or death), or any damages or losses (whether it be indirect or consequential losses, loss of business, loss of revenue, loss of income, or loss of profits) that results from the Client's, Candidate's, or Visitor's use of any description of the Site and its Services, or of any affiliated Site.

B) The Site and its Administrators cannot guarantee that the Site at cv-matchmaker.com, any affiliated Site, or any Site that is directly or indirectly linked in any way, will be free from computer viruses, "cookies", or any malicious, damaging, or impairing code. The use of the Site and any affiliate or link of the Site remains at the Client's, Candidate's, and/or Visitor's own risk.

C) The Site and its Administrators do not accept any liability of any type or form, and however arising, for any losses, impairment, or damages caused to any Visitor, Client, Candidate, or user of the Site, or any third party at all, as a result of the access to or use of any CV of any Candidate, or any of the information provided by the Site and/or its Administrators about/from Candidates, whether these losses, impairments, or damages result form malicious code/programmes, programming errors, or for any other reason.

D) The Site and its Administrators do not accept any liability for the loss or impairment of any copy, intellectual property, logos, photographs, creative material, or any data whatsoever provided to it or through it by any Candidate, Client, or Visitor of the Site.

E) Clients, Candidates, and/or Visitors will, by virtue of using or accessing the Site and/or its Services, or those of any of its affiliates, agree to completely indemnify the Site, its Administrators and any of its affiliates from any claims or liabilities resulting from failures to obtain the express consent of any person, body, or third party to use, store, process, or disclose any information of such a person, party, or body that is covered by the Data Protection Act 1998.

Indemnity


Clients, Candidates, and/or Visitors of the Site at cv-matchmaker.com and/or any of its affiliates agree to indemnify the Site and its Administrators and to keep the Site and its Administrators indemnified in respect of, but not limited to, all liabilities, costs, damages, or legal challenges that may arise from any use of any of the Services of the Site or any Advertisement placed on or through the Site, resulting from (but not limited to):

  • Breach of copyright and/or any trademarks.
  • The violation of any intellectual property rights.
  • Any claim of any form of discrimination.
  • Any breach of the Terms and Conditions and Posting Rules of this Site.
  • The publication of any discriminatory, libellous, and/or defamatory statement/s.

Disclaimer


Except where provided by statute, the Site and its Administrators disclaim all warranties, express or implied by law of statute, in relation to, but not limited to, the Site and/or any of its affiliates.

Governing Law and Jurisdiction


The Terms and Conditions of the Site shall be governed by, and construed in accordance with, the laws of England and Wales and any Client, Candidate, and/or Visitor of the Site or any of its affiliates irrevocably submit to the exclusive jurisdiction of courts of England and Wales.

Posting Rules


These Posting Rules are to be considered part of the Terms and Conditions of the Site. Any definitions of words or phrases set out in the Terms and Conditions will also apply to these Posting Rules. As with the Terms and Conditions, these Posting Rules may be modified, changed, or amended at any time by CV-Matchmaker and/or any of its Administrators, and the Client’s continued access to or use of the Site indicates that the Client agrees to be bound by the most current version of the Posting Rules.

  1. Only one specific vacancy/position/job may be advertised per job posting.
  2. Recruitment Agencies or recruitment-related businesses need to clearly identify themselves and the nature of their advertisement in the Advertisement content.
  3. The Site will not accept advertisements for employment positions related to the Adult Entertainment industry, or those relating to medical trials.
  4. The Site will not accept postings and/or Advertisement Content which contain links to or direct Candidates or Visitors in any way to any other websites which offer job posting services/facilities.
  5. The Site will not accept or allow job postings or Advertisement Content which require or request that Candidates send money to another party for whatever reason.
  6. All Advertisement Content is to be written in the English language.
  7. All Advertisement Content is to be kept within the confines of and guidelines set out by the UK Commission for Racial Equality and the Equal Opportunity Commission’s Code of Practice.
  8. No Advertisement may indicate in whatsoever form any direct or indirect intention by any party to discriminate against Candidates (or any other party) on any illegal or immoral grounds whatsoever including, but not limited to, their colour, race, ethnicity, nationality, sexual-orientation, disability status, marital status, age, sex, or gender.
  9. The Site and its Administrators reserve the right to at any time and without notice or refund remove, suspend, modify, or amend any Advertisement and/or job posting which breach the Terms and Conditions and Posting Rules of the Site.

Privacy Policy


A) The Site and its Administrators are committed to following all the rules and guidelines as set out by the Data Protection Act 1998. In relation to this, the Site and its Administrators are committed to protecting any personal information, details, or data that is provided to them via any Client, Candidate, or Visitor of the Site and/or any of its affiliates.

B) All information provided by Clients or Visitors of the Site as part of the sign-up process will be kept confidential and exclusive by the Site and its Administrators and will not be intentionally passed on to any third party.

C) If you would like to update any of the information provided to the Site as part of the registration process then you will be able to either change this information on the Site or send the Administrators an email using any affiliated email or the "contact us" form available on the Site.

D) Any information or details provided to or through the Site by Candidates shall only be disclosed to recruiters who match the Candidate’s needs and requirements. Candidates have the right at any time to request that their information/details be removed from the Site and/or not used for any reason as provided through their personal instructions to the Administrators of the Site.

E) Any information or details provided to or through the Site by Client’s shall be kept confidential at all times unless otherwise instructed by the Client itself. Client's information and details will not be passed on to Candidates unless it is the express wish of the specific client.

F) The Site and its Administrators reserve the right to access and/or disclose any personal details/data/information about any Client, Candidate, or Visitor of the Site should this be necessary to comply with any applicable laws and/or regulations (or requests from any legitimate authority), or for any reason which the Site and its Administrators feel is justifiable under the Data Protection Act 1998.

G) This Privacy Policy is subject to change at any time and for any legitimate reason as decided by the Site or its Administrators. If it is changed or amended, the new Privacy Policy will be posted on the Site with or without any notification and will take effect immediately. It is therefore necessary to visit the Privacy Policy regularly to take note of any changes and/or amendments.
